Proposition 133

BALLOT LANGUAGE

Shall there be a change to the Colorado Revised Statutes modifying existing law concerning human trafficking of a minor for sexual servitude, and, in connection therewith, creating new law expanding human trafficking of a minor for sexual servitude to include knowingly trading anything of monetary value to buy or sell sexual activity with a minor and increasing the penalty to be life in prison without parole or release?

WHAT IT MEANS

Yes

A “Yes” vote means that you desire to amend Colorado Statute to expand the definition of sex trafficking of a minor to include knowingly trading anything of monetary value to buy or sell sexual activity with a minor and make sex trafficking of a minor a class 1 felony with a penalty of life in prison without parole.

No

A “No” vote means that you desire to keep current Colorado Statute which classifies sex trafficking of a minor as a class 2 felony with a penalty of a fine, 8 to 24 years in prison, or both.

“Age 14. That's the average age a child is first bought and sold into sex trafficking. Our ballot measure sets a penalty of life in prison without parole for anyone who buys or sells a minor child for sex in Colorado. Certain punishment, without a chance to ever brutalize another child. It's time Colorado voters loudly say, "Not here. Not once. Not ever." - Protect Kids Colorado   

“Children should never be exploited. Exploitation of children for sex is especially heinous. This measure would impose life in prison without parole for anyone who buys or sells a minor for sex in Colorado.

“Initiative 108 is a Trojan horse using the language of child protection to advance a broader political agenda rather than reflect the best practices for supporting survivors.” - Families Not Politics 

"...the new definition of human trafficking of a minor for sexual servitude is broad and can include human trafficking victims. The further broadening of the crime by this initiative to include persons knowingly trading anything of monetary value to buy or sell sexual activity with a minor makes the prosecution of human trafficking victims more likely. There are also concerns that the new definition of human trafficking of a minor for sexual servitude is vague enough to include parents assisting out-of-state children obtain reproductive and gender-affirming care. 

Additionally, the initiative mandates prison sentences of life without parole or release for all those convicted of this crime, without consideration of the circumstances of the crime and individuals’ situations and roles. The League believes judges should have discretion in sentencing guilty persons and should take into account the circumstances of the crime and the defendant’s situation and role.” - League of Women Voters of Colorado
